Gallery Agreement

Last updated: September 27, 2026

This agreement is between ARTCURA and the gallery that applies to sell on artcura.ai ("you"). It applies whether you applied through this site or ticked "Sell on the Artcura marketplace" in Artcura for galleries.

1. You are the seller

Artcura is not the seller. Every sale made through the marketplace is a sale by the gallery, in the gallery's own name, settled into the gallery's own payment account. Artcura provides listing and software and charges a fee for that service. The gallery is solely responsible for determining, collecting, reporting and remitting any sales, use or other transaction tax on its sales, and for maintaining its own tax registrations. Artcura does not calculate, collect, remit or file tax on a gallery's behalf.

Every listing, checkout page and receipt names you as the seller of record, so a collector knows who they are buying from before they pay.

2. What you are responsible for

  • the authenticity, provenance, condition and description of every work you list;
  • your right to offer each work, including work you hold on consignment;
  • packing, insuring and shipping a sold work, at the shipping cost your listing quoted;
  • tax: your registrations, your calculation, your filings, on your own Stripe account;
  • refunds, returns, chargebacks and payment disputes;
  • confirming each order within 24 hours. An order you do not confirm in 24 hours may be refunded in full.

3. Money

Payment is taken on your own Stripe account by direct charge: you are the merchant of record and the funds are yours from the moment they settle. ARTCURA takes a platform fee of 3% of the artwork price from each completed sale, and Stripe takes its own processing fee in addition. There is no listing fee, no subscription and no fee to the collector.

A sale that originates on the marketplace pays the 3% and nothing else. If you also run Artcura for galleries, that register's own fee does not apply to it: the two are never charged on one sale.

4. Your inventory stays yours

You publish what you choose to publish. Works reach the marketplace from a feed you control, and withdrawing a work withdraws it. A work a collector has in checkout is held for 30 minutes; if you run Artcura for galleries, that hold is the same hold your own counter sees, so a work cannot be sold twice.

5. Curation and ending it

Applying is not listing: we approve galleries by hand, and we may decline one or stop showing one. You may stop selling here whenever you like, by untickling the box in Artcura for galleries or by writing to us. Orders already placed still have to be fulfilled.
